1. Acceptance of Terms
By downloading, accessing, or using the PoquitoTalk mobile application, web application, or website (collectively, the "Service"), provided by Hero-Apps ("we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.
2. Description of Service
PoquitoTalk is an assistive communication utility designed to help English-speaking expats, visitors, and residents communicate effectively in Panamanian Spanish with local contractors, businesses, and services in Bocas del Toro and across Panamá. Core features include speech-to-text translation, natural Spanish voice note generation for WhatsApp, phrase templates, an offline island dictionary, and a community contractor directory.
3. Use of Speech & Audio Synthesis
PoquitoTalk utilizes advanced speech processing and AI-assisted models to generate context-specific translations and synthesized voice notes. While we strive for high accuracy and culturally calibrated phrasing:
- Translations are provided on an "as-is" assistive basis and should not be relied upon for critical legal, medical, or life-safety emergencies.
- Users retain responsibility for the content, tone, and context of messages sent to third parties via WhatsApp or any other platform.
4. Subscriptions, Credits & In-App Purchases
PoquitoTalk provides both free tiers and paid subscriptions / credit packs:
- In-App Purchases: Subscriptions and one-time credit packs purchased via the Apple App Store or Google Play Store are subject to the billing terms and policies of the respective store.
- Web Purchases: Web-based subscriptions and credit packages are processed securely via Stripe Checkout.
- Cancellations & Refunds: In-app subscriptions may be managed or cancelled at any time through your Apple ID or Google Play Account settings. Refund requests for store purchases are handled directly according to Apple/Google store refund policies.
5. Community Directory & Independent Service Providers
The PoquitoTalk Community Directory lists independent third-party service providers (e.g., boat captains, A/C technicians, electricians, plumbers). Important notices regarding directory listings:
- Listed service providers are independent individuals and contractors, not employees or agents of PoquitoTalk or Hero-Apps.
- We do not guarantee, warrant, or assume liability for the quality, safety, pricing, licensing, or outcome of services rendered by third-party contractors.
- Users negotiate and contract directly with independent service providers at their own discretion.
6. User Conduct & Prohibited Uses
You agree not to use PoquitoTalk to transmit unlawful, harassing, defamatory, abusive, or fraudulent content; attempt to decompile or reverse-engineer the underlying application code; or interfere with the normal operation of the Service.
7. Limitation of Liability
To the fullest extent permitted by applicable law, PoquitoTalk and Hero-Apps shall not be liable for any indirect, incidental, consequential, or punitive damages resulting from your access to or inability to use the Service, translation discrepancies, or interactions with third-party service providers.
8. Privacy & Data Security
Your privacy is paramount. Please review our Privacy Policy to understand how audio clips, session tokens, and local preferences are handled in accordance with GDPR and CCPA standards.
9. Changes to Terms & Contact
We may update these Terms periodically. Continued use of the Service following any updates signifies acceptance of the revised Terms.
